We inform you that on May 28, 2020, the Energy Regulatory Commission ("CRE") published in the Federal Official Gazette  ("DOF"), a project of resolution which exposes the charges for the electric power transmission service at 2018 prices to be applied by CFE Intermediación de Contratos Legados, S. A. de C. V.

We inform you that on May 28, 2020, the Energy Regulatory Commission ("CRE") published in the Federal Official Gazette  ("DOF"), a project of resolution which exposes the charges for the electric power transmission service at 2018 prices to be applied by CFE Intermediación de Contratos Legados, S. A. de C. V. ("CFE-ICL"), applicable to holders of legacy interconnection contracts with power generation plants of renewable energy sources or efficient cogeneration, pursuant to Resolution RES/066/2010 and its amendment contained in Resolution RES/194/2010 (the "CRE´s Project Resolution"), acts that can be fund in the following link:

Subsequently, on June 10, 2010, the CFE-ICL published in the DOF the "Notice regarding Charges for Transmission Service for Renewable Energy Sources or Efficient Cogeneration by Voltage Level, at 2018 Prices" (the "CFE´s Notice"), which can be found in the following link:

Therefore, the most relevant points derived from the Notice are the following:

 

  • There is a disproportionate increase in Transmission Service Charges of up to 800%.
  • The companies will be affected legally and financially since they do not know the original conditions of the respective contracts.
  • The CRE's Project Resolution and the CFE´s Notice may be appealed through the corresponding means of challenge, if the rights of those who had executed Legacy Interconnection Contracts are transgressed, as referred in both documents.
